A Sillpo cashier mistakenly let goods worth 9,854 hryvnias go without scanning them. Here’s what the court decided regarding the incident.

The sales consultant at Silpo incurred losses totaling 9,854 hryvnias. He sold goods without conducting cash transactions. This is stated in the verdict of the Railway District Court of Lviv, published on November 25, 2024.

According to the order dated August 16, 2023, the man was appointed as a sales consultant in the merchandise department of store No. 372 of "Silpo-Food" LLC, located at: Lviv, Sadova St., 2A. During the sale of goods, he sold items to individuals without conducting cash transactions, specifically: 2 bottles of liqueur, 36 bottles of beer, 1 kitchen sponge, 3 bottles of mineral water, 2 boxes of whiskey, 1 loaf of yeast-free wheat bread, 3 bottles of liqueur, 3 pieces of cheese, 1 pack of spinach, 1 sandwich snack, 2 bottles of whiskey, 1 bottle of rum, and 5 bottles of "Coca-Cola," causing material damage to "Silpo-Food" LLC amounting to 5,090 hryvnias. Additionally, the individual also committed embezzlement of the following goods: 4 bottles of whiskey, 1 bottle of rum-based drink, 2 packs of butter, 3 deodorants, 5 bottles of mineral water, 3 bottles of juice, 3 packs of cracker cookies, 1 pack of puree, 1 bottle of gin, 2 bottles of sparkling wine, 1 tube of toothpaste, 7 packs of pet food, 4 bottles of juice, 6 packs of sweet cream butter, 3 packs of sweet cream butter, 1 pack of filter cigarettes, 2 bottles of beer, 1 pack of filter cigarettes, and 1 bottle of beer, resulting in total losses of 4,764 hryvnias.

At the court hearing, the accused did not deny his guilt. He sincerely repented of his actions and asked the court not to impose a severe punishment.

What punishment did the court choose?

The court found the man guilty of committing a criminal offense under part 4 of article 191 of the Criminal Code of Ukraine and imposed a sentence of 5 years imprisonment, along with the deprivation of the right to hold certain positions or engage in specific activities related to accounting, storage, management, and disposal of material assets for a period of 1 year. Based on article 75 of the Criminal Code of Ukraine, he was released from serving the imposed sentence on probation for a trial period of 1 year. Under article 76 of the Criminal Code of Ukraine, the following obligations were imposed on him: to periodically appear for registration at the authorized probation authority, and to notify the authorized probation authority of any changes in his residence, employment, or education.
