During the period of martial law in Ukraine, certain categories of men of conscription age are eligible for deferral from mobilization. Can men receive this if they have been served a summons? Lawyer Dmitry Franchuk explained this to "RBK-Ukraine".
"Receiving a summons does not automatically mean conscription. If you have legal grounds for a deferral, such as education, childcare, poor health, etc., you have the right to submit a deferral application," said Dmitry Franchuk.
Steps to follow:
The lawyer noted that in case of a denial of the deferral without sufficient grounds, the individual has the right to appeal this decision through administrative procedures or in court.
"The sooner you submit your application, the quicker your issues will be addressed. If you encounter difficulties or are unsure about the correctness of your documents, consult a lawyer," the expert advised.
Dmitry Franchuk added that submitting an application to the TCC will protect the rights of the conscripted man and ensure that he will not be called up for military service if he has legal grounds for a deferral.
"Additionally, submitting the application will help avoid misunderstandings and conflicts with the TCC and SP. The key is to act promptly and ensure that all documents are available to prove your right to a deferral," Franchuk emphasized.
We also remind you that when checking documents, employees of the TCC have certain authorities. They must adhere to the necessary legislative requirements.
